General terms and conditions of Sale

Preamble

This site is published by the company Open Minded People Exclusively, limited liability company to the capital of 6.000 euros, whose registered office is located 19 Résidence Courdimanche  - 91940 Les ULIS, and identified at the Trade register of Evry under the number 488 823 030.
The present general conditions of sale define the rights and obligations of the parts within the framework of the sales carried out via the site www.4ompe.com. They regulate all the stages necessary to the making and the follow-up of the order.
These conditions only concern the noncommercial, natural persons of at least 18 years and having the legal capacity to contract.
It is specified that you can safeguard or print the present general terms and conditions of sale.
Open Minded People Exclusively reserves the possibility of adapting or of modifying constantly the present general terms and conditions of sale. In the event of modification, will be applied to each order the general conditions of sale in force at the day of the placing of the order.

Orders

The order can be ony be placed once a username and password has been provided.
The products are sold within the limit of available stocks. In the event of unavailability, Open Minded People exclusively commit themselves of informing you either at the time of the placement of orders or as soon as possible by email or mail in the case of exceptional unavailability after validation of your order. You will only then be debited with the sum of the dispatched articles.

The final validation of the order intervenes after validation of the payment.
After having placed your order we send an email confirming to you the recording of this one, with a summary of the ordered articles and address of delivery.
The prices are indicated on the site in euros, inclusive of tax. They take into account the VAT applicable at the day of the order. These prices get along except carriage paid.
Any change of the applicable rate could be reflected on the prices of the products. After this date, they are likely to be modified constantly. However the prices could not be modified once the placement of the order by the customer done. In the same way, if one or more taxes or contributions, in particular environmental had been suddenly created or modified, raising or dropping, this change could be reflected on the selling price of the articles present on the site of Open Minded People Exclusively.
You will have to discharge, in addition to the price of the products, of a fixed contribution to the expenses of sending and treatment of your order whose amount will be specified on the purchase order before validation of the latter.

Payment

All transaction will be conducted online with a credit card.
Opend Minded People Exclusively accepts all French bank card, (with the CB logo) and international cards ( Visa or Mastercard).
The card number, the expiration date, and  as well as the cardholder’s name must be provided. For further security the 3 digits security code located at the back of the card, must be provided at the time of purchase.

Delivery

Initially, the consignment of the parcels will only be carried out in France, DOM TOM and in Monaco, and in exceptional cases outside this zone.
If the user resides outside the zones aforesaid above and wishes to obtain a delivery abroad, Open Minded People Exclusively will address to them an estimate which will have to be accepted by the user before validation of their order.
The order is dispatched to the address of delivery by followed parcel

Open Minded People Exclusively commit THEMSELVES of carrying out the deliveries of the ordered articles as soon as possible. The noted average time is 5 days.
The delivery cannot be ensured in the case of a cause beyond control as defined by jurisprudence and in case of strikes.

Right of retractation / Returns

In the 15 days which follow its reception to the residence of the withdrawal of the parcel, Open Minded People Exclusively exchanges or pays back an item if it does not give you whole satisfaction.
The sent back articles by the customers which are spoiled, damaged, or dirtied are not taken back.
You can return your article by post, at your expenses, to the following address : SARL OMPE, 228 rue paul Vaillant Couturier - 94140 Alfortville - FRANCE.
The fixed contribution corresponding to stamp charges and treatment of your order remains at your expenses, except if the article is defective. In this case it is paid back to you as well as the expenses of return (within the limit of the tariff grid of the simple "Colissimo").
Join to the sending back the lower part of the delivery slip and preserve the higher part which will act as a guarantee.
The repayment of the price of the products will be carried out within 30 days from the reception by Open Minded People Exclusively.
In case of abnormal or abusive returns Open Minded People Exclusively reserves the right to refuse a further order.
To facilitate the treatment of the complaints concerning any operation outside guarantee, it is important that you get in touch within 3 months time.

Guarantees

In accordance with the regulation, Open Minded People Exclusively commit themselves to respecting their obligations relative to the guarantees attached to the products sold on their site and which appear in the articles extracted from the Code of Consumption and the Civil code hereafter :
The salesman is held to deliver a slip in conformity with the contract and to answer of the defects of conformity existing at the time of the delivery. He also answers of the defects of conformity resulting from packing.
Consumption code - L211-4 article
To be in conformity with the contract, the commodity has to :
1) be appropriate to the use usually awaited from a similar commodity and if need be :
- to correspond to the description given by the salesman and to have qualities that this one presented to the purchaser in the form of sample or of model.
- to present the qualities a purchaser can legitimately await concerning the public statements made by the salesman, the producer or their representative, especially in advertising or labelling.
2) or to offer the characteristics defined by a mutual agreement between the parties or to be appropriate to any special use sought by the purchaser, made known to the salesman and that this latter has accepted.

The action resulting from the defect of conformity is prescribed after two years from the delivery of the commodity.
(Code of Consumption - L211-12 article)
The salesman is held of the guarantee at the rate of the hidden defects of the sold thing and which make it unsuitable to the use for which one intends it, or which decrease so much this use, that the purchaser would not have acquired it, or would have given only one less price, if he had known them.
(Civil Code - 1641 article)
The proceedings resulting from the redhibitory defects must be brought by the purchaser within two years time from the discovery of the vice.

Open Minded People Exclusively commit themselves to protecting the private life of the people using their web site and the confidentiality of provided information.
Information and data concerning you are necessary to the management of your order and to our commercial relations. In no case transmitted information and data concerning you will be communicated to a third party without your agreement.

Proof

In case of litigation, a friendly solution will be required before any legal recourse.
